Police inspector fined for illegal detention

Detaining a suspect on the charge of receiving stolen property without a record has proved costly for a city-based inspector, as the State human rights commission has found him guilty and directed him to pay a compensation of ₹50,000.

The incident dates back to March 2024 when the Bharatinagar police, while probing a mobile snatching case reported on January 13 at Nehrupuram, arrested the accused Syed Asif. The accused allegedly told the police that he had sold the phone to Nayeem Pasha following which the police detained him and allegedly recovered the phone and kept him in custody along with Asif on March 29.

The police personnel allegedly demanded ₹50,000 from the wife of Pasha when she went to the station to enquire about her husband. Unable to pay, she approached the SHRC with a complaint against the police for illegally detaining her husband.

Based on the complaint, an SHRC team led by Deputy Superintendent of Police Mohan S.Y. visited the station and conducted an inquiry with Pasha, police personnel, witnesses, and the inspector. The officials also verified CCTV camera footage to ascertain the allegations.

The probe revealed that the police personnel did not press any charge against Pasha even though he could have been arrested on the charge of receiving the stolen property, nor was produced before the court.

Based on the fact-finding team’s report, the SHRC has recommended to the Chief Secretary to pay a compensation of ₹50,000 to Pasha for violating his rights and recover the compensation amount from the salary of the inspector. The commission also asked the government to submit the action-taken report within a month.
